Many of those who have had to make a compensation claim for a work related illness will have been forced to take an extended period of sick leave as they have been unable to return to the role that they were formerly in at the time they contracted their illness.
Some employees injured in a work accident may never be able to return to the same job due to the extent of their injuries meaning that many face long periods of unemployment or early retirement.
However, the introduction of the 'fit note' in April 2010 promised the opportunity for employees to return to work in a role which takes the constraints of their illness or injury into account. Brought in to target the 2.6 million workers claiming incapacity benefits in 2008 and the £10 million pounds that sick days cost the economy each year, the new style of 'sick note' was hoped to reduce the need for long periods of sick leave.
The 'fit note' is a replacement of the doctor's sick note and rather than stating that the employee is unable to work, it outlines what work the employee can do. It is therefore aimed at combating those on sick leave who drift into long term non-work as they aren't capable of carrying out their former role. For example, if the employee has a problem with mobility, their employers may be able to find them a different role sitting down.
Speaking at the time the 'fit note' was introduced, Work and Pensions Minister Lord Bill McKenzie, said, "Employers tell us that managing sickness absence can be a challenge. We recognise how important it is to help people who are sick to stay in work or get back to work quickly the new fit note will help do just that."
The notes were developed with the support of healthcare professionals, employer representatives and trade unions. However, the note was met with criticism as unions argued that Doctors pressed for time will struggle to judge what kind of work people can do, meaning that workers will be sent back too soon. Some doctors also raised concerns about whether firms will understand their end of the deal.
