Successful work accident claim for delivery man

During September 2005 we received a phone call from an ex-delivery man in Huddersfield, West Yorkshire, who wanted our help to make a work-related accident claim.

Unfortunately, he was not been provided with a cycle helmet and landed heavily on the side of his head, was knocked unconscious and sustained a serious closed head injury. He also badly grazed the skin from his left side and fractured his left leg and knee joint.

He was found by a local woman who was horse riding along the same lane. She phoned for an ambulance, covered the man with her coat and talked to him until the emergency services arrived. The man was taken to A&E and treated for his personal injuries then kept in for 12 days. After a thorough examination and a CT scan doctors diagnosed the delivery man with minor brain damage and warned him and his family that he may experience problems with his memory, moods and concentration.

Several months passed before the man felt able to return to work and when he did he found it very hard going. He could no longer ride a bike because the damage to his leg had left him suffering ongoing pain so he was reassigned to the sorting room. He found this job difficult as it was tedious and wasn't made any easier by his lack of concentration.

This was making him very unhappy and he decided to talk to his employers. They said there was little they could do so he decided that he had no choice but to cease working for the company.

He knew that he could not support his wife and two children on fresh air and had already lost two months earnings while he was recovering from his personal injuries.
