Osteoarthritis affecting mine worker's knees, a condition also known as miner's knee, was added to the list of prescribed diseases for which work-related compensation is payable by the Government in July 2009.
The Industrial Injuries Advisory Council has stated that miners who have worked underground for ten years or more should be able to claim a regular payment of Industrial Injuries Disablement Benefit through the state benefits system.
Symptoms of miner's knee include pain, swelling, stiffness and reduced mobility, all of which worsen with the age of the victim, usually increasing their disability and dependence on the care of others.
Many miners have ended their working lives in pain as a result of the condition or have taken early retirement with subsequent loss of earnings through developing the osteoarthritis which could be attributed to their employment.
Although the Government has accepted that miners have suffered from this work-related illness as a result of their time in the pits, alongside HAVS (hand arm vibration syndrome) which arises from use of power-operated drilling equipment, other disabling conditions affecting underground workers have not been given the same recognition.
Bursitis or subcutaneous cellulitis can occur as a result of any type of manual labour causing severe or prolonged external friction on a joint, such as the hand, elbow or knee. The term ‘beat’ is often used to describe this injury whereby small sacs of synovial fluid, the bursae, become inflamed.
Bursitis is usually caused by repetitive movement and excess pressure on one particular joint and is an occupational hazard of many jobs, as well as mining. Housemaid's knee and tennis elbow are among common descriptions of this type of injury.
The principal of offering Industrial Injuries Benefit to miners and ex-miners suffering from osteoarthritis of the knee and bursitis show that the Government accepts that the conditions have resulted from the men's employment and were not caused through their own fault.
However, other disabilities which can be connected to someone's employment may be more difficult for a victim to prove and the services of a specialist personal injury lawyer experienced in industrial illness, who is able to call on medical experts and relevant case law, will be needed to bring a suitable damages claim.
