Falls from height are one of the major causes of preventable personal injury which occur in the workplace. If such a fall has caused a worker to suffer pain and loss of earnings it is likely the firm responsible will face a work injury compensation claim which would be pursued through the civil courts.
In October 2010, following a work accident investigation, the Health and Safety Executive Northern Ireland (HSENI) brought a prosecution against a construction company from County Down in Northern Ireland after building work caused a fall from height which left a worker permanently injured.
Construction and fall from height dangers
The company had been entrusted with the building of a waste water chamber on a pumping station in Bangor a year earlier. The injured worker had fallen into the 6.4 metre deep chamber, sustaining severe head injury and damage to his spine which effectively left him in a paraplegic condition.
The HSENI investigation found that access areas in the roof of the chamber had not been adequately covered and access routes into the chamber were not of sufficient safety standard.
Kevin Campbell, an inspector with HSENI, said, "It is vital that companies identify and address hazards within the workplace. Falls from height must be prevented by the implementation of sensible and effective procedures.
"These systems need to be communicated to the workforce, implemented, maintained and updated when necessary.
"Simple measures would have prevented workers on this project from falling."
The construction company was fined £80,000 for its part in the accident after admitting two breaches of health and safety legislation.
Making a work injury compensation claim after a successful prosecution
A successful prosecution by the HSE is usually the first step in making a work injury compensation claim. Once the courts have apportioned blame for the accident, the personal injury victim is far more likely to be successful in their claim for damages
