Regulations to prevent work accidents involving dangerous substances


Work accidents involving fires and explosions can be some of the most life threatening and catastrophic in terms of death and injury inflicted on workers and the general public. Where work requires the use of dangerous and flammable substances the risk must be managed by owners and employers.

DSEAR and the substances applicable
The Dangerous Substances and Explosive Atmospheres Regulations (DSEAR) are a set of laws dealing with such risks in the workplace and apply to employers and the self-employed.

Dangerous substances include items such as petrol, liquefied petroleum gas (LPG), paints, varnishes, solvents, and dusts which can become explosive when mixed with air, such as those caused by milling and sanding operations. A detailed definition of what constitutes a dangerous subject can be found in the Regulations, but they are generally any substance or preparation which could cause harm to people as a result of its flammable or explosive qualities that have potential to cause a work accident.

Do you work in an explosive atmosphere?
If your work area is prone to build-ups of gas, mist, dust or vapour that mixes with air and could possibly catch fire or explode than you are at work in an "explosive atmosphere". This atmosphere may not necessarily result in an explosion, but the air has the potential to catch fire and the resulting flames would spread rapidly, which in turn could cause an explosion, particularly in a small space such as a plant or equipment room.

DSEAR for employers and the self-employed
The regulations apply for any workplace where a dangerous substance is present or might be present if certain circumstances prevail.

Under DSEAR all employers and the self-employed must:

  • undertake adequate risk assessment of work procedures that involve dangerous substances or materials with the potential to be dangerous;

  • identify and present measures to eliminate or reduce risk as far as is practicable

  • provide procedure planning and equipment to handle accidents and emergency situations;

  • give full information and training to employees; and,

  • classify hazardous work areas as detailed in the Regulations and clearly mark the zones as applicable.
