In order to prevent a work accident employers have a legal duty to provide full training and to review safety procedures when employees are carrying out all tasks that carry any degree of risk. To establish the danger to workers and any other people who may be present, a risk assessment should be completed as a measure to prevent personal injury.
In February 2009, a property developer from Nottingham was fined after an accident that occurred in 2007 left a worker unable to work for eight months.
A telescopic materials handler was being used to reach inaccessible parts of the building that was being worked upon. The vehicle had been fitted with a cage to transport workers, but the driver of the handler had not been fully trained and had not secured the cage properly.
The cage became dislodged from one of the handler’s forks and fell 2.5 metres to the ground. The employee in the cage broke his wrist in the construction accident fall from height.
The driver was unaware of safety devices in the cab of the vehicle that could have prevented the accident and the worker in the cage was not wearing a harness at the time of the fall.
Appearing at Lincoln Magistrates’ Court, the property developer admitted failing to ensure that contractors were not exposed to risks of falls. A fine of £10,000 pounds was ordered and court costs £3,362 were also levied.
Health and Safety Executive (HSE) Inspector Martin Giles said, "[In 2008] 61 people died and more than 14,000 suffered a serious injury after a slip, trip or fall from height at work. It is the most common cause of death at work.
"It was only through extreme good fortune that other workmen did not suffer the same fate."
