The dangers of poor supervision and lack of training in the workplace were once again highlighted in July 2009 when two builders were sentenced in court after a tragic work accident caused the death of a 15-year-old boy in 2007.
The accident occurred when the young labourer and his 18-year-old brother were left, unsupervised, to dismantle a 23ft wall at a private address in Hadley Wood, Essex. The wall was unstable and the 15-year-old was killed instantly when it fell onto him.
The court heard how the 47-year-old contractor from Essex had sub-contracted the work to another builder after telling him the wall needed to be brought down brick by brick. But it was alleged that the 64-year-old sub-contractor, merely gave the brothers a sledgehammer and a pneumatic hammer, no protective equipment or clothing, and left them to demolish the wall without further instructions.
At an earlier hearing the sub-contractor had denied manslaughter, but as the case went to retrial at the Old Bailey he changed his plea.
The judge told him, "You adopted a cavalier and thoroughly irresponsible attitude to the brothers' safety
"Your actions – or lack of them – on that day were criminal."
The contractor was jailed for a year after being found guilty of health and safety breaches and working while disqualified from being a company manager.
The sub-contractor was convicted of manslaughter by gross negligence and was jailed for three years.
The real tragedy in this case, as in many work accidents, is that it could so easily have been avoided – full and thorough risk assessment, the provision of safety equipment such as hard hats, and proper supervision of the task may have prevented the tragedy.
The 15-year-old, from Latchingdon in Essex, became the youngest worker ever to be killed on a construction site.
