Following a 2008 prosecution after a work accident, the Health and Safety Executive (HSE) strongly advised employers to reassess their risk assessment and safety procedures.
A fruit packing company was charged with breaches of the Health and Safety at Work Act 1974, section 2(1), following a work injury to one of their staff.
On the day of the accident, the operative was carrying out routine maintenance work whilst standing on a platform that fell from the forks of a forklift truck as it was manoeuvred by an unauthorised driver. The employee sustained broken ribs and several other injuries.
The court ruled that other workers had also been put at risk. The platform had not been adequately risk assessed and the work platform in question was not suitable for daily use.
A HSE Inspector said, "Falls from height remains the biggest cause of fatal injuries in Great Britain; 45 workers were killed and 3,409 suffered major injuries as a result of falls from height whilst at work in 2006/2007 alone. The fact that serious injury can result from falls of any kind makes it all the more essential for employers to have safe working procedures for working at height. "It should not be necessary for each generation to rediscover principles of safety which the generation before already discovered. We must learn from the experience of others rather than learn the hard way. "The HSE will not tolerate employers exposing their employees to unacceptable risks at work. The HSE has always been available to give advice in relation to health and safety at work. There is simply no excuse for employers to plead ignorance of good health and safety practice".
