Anyone who has injured their back or neck in an accident and is considering making a case for whiplash compensation is likely to have consulted a doctor at the earliest opportunity after the injury was sustained, especially if substantial pain and lack of movement are involved.
In such circumstances, medical staff often request x-rays to look for hidden damage to the spine, such as a fracture, which may require further treatment. However, it is not possible to diagnose whiplash from an x-ray, CT scan or MRI scan.
Although most people who sustain a whiplash injury will recover quite quickly from its effects, there are a small minority who may suffer for weeks or even months and the condition can be quite debilitating, restricting every-day life, particularly driving.
There may be a little residual neck discomfort but, eventually, with specialised exercise, painkillers and possibly physiotherapy or massage, everyone who has had an accident resulting in a whiplash injury will recover.
As far as long-term consequences are concerned, there is some disagreement among medical researchers on whether a neck injury incident will lead to increased frailty of the spinal column and it is a difficult theory to prove.
MRI scans can provide greater diagnostic tools than a standard x-ray but still cannot definitively prove that a back condition has been caused by a whiplash injury rather than being the consequence of a genetic malformation, general ageing or some previously untreated injury.
Whiplash sufferers have not been shown to have a higher degree of spinal disc degeneration or similar chronic problems than an average member of the same population.
If someone is in pain through a neck or back problem and has been involved in a whiplash incident, they are likely to make a correlation between the two but this may not be the case if they had a previously-untreated back problem.
This confusion could cause difficulties for medical staff trying to help the patient and the victim himself who will not understand the differences.
However, if someone has sustained a whiplash injury through no fault of their own and has suffered or continues to suffer from pain as a result, they should not be put off seeking both immediate medical help and consider if it is appropriate to make a claim for recompense.
