There are so many factors at play in the settlement of a whiplash claim that it can be difficult to say there is a definitive average compensation payout for whiplash.
(Visit the YouClaim compensation calculator to find out compensation amounts for all injuries to the head, neck and body)
For the most part, the size of a settlement will depend very much on the severity of injury suffered, the strength of the medical evidence presented and the skill of the no win, no fee solicitor charged with representing the case.
Strictly speaking, it is possible to calculate a figure for the average compensation payout for whiplash; 70% of all car accident claims are made for the injury so all one need do is add up the total amount of compensation awarded in a single year and divide it by the number of claimants.
However, to only do this could create a misleading picture; more severe injuries that result in chronic pain such as Whiplash Associated Disorder are more likely to be compensated with five-figure sums, while the mildest injuries may be only be compensable for £500 or so.
There is also the issue of 100 percent compensation: if a claimant is deemed partly responsible for the accident that caused the injury, he or she will only be entitled to compensation at the percentage the other party is deemed at fault.
For example, if liability for an accident is determined to be 40 percent the claimant's fault and 60 percent the defendant's fault, the claimant will receive only 60 percent of what she or he would otherwise do.
All this said, most claimants should expect to receive between £2,000 and £2,500 for their neck injury (calculated 2009); this though is not an absolute average.
The absolute average is approximately £3,500; a figure slightly distorted by the payouts received by sufferers of chronic whiplash-type injuries.
Perhaps the most important indicator of payout size is recovery time. Roughly speaking, those who recover within 12 months will receive up to £2,500; those who recover within four years, up to £7,750; those with persistent symptoms, upwards of £7,750.
