Sometimes it is the case that a defect inherent in a product only comes to light long after it has caused personal injury. A good example of insurance companies taking out a product liability claim occurred in 2011. It involved seven insurers, all of which believed they had suffered financial loss as a result of alleged defects present in the acceleration systems of various Toyota vehicles.
Lawyers representing the claimants argued that they had, in good faith, paid out over $10 million (US) in personal injury compensation, including no win, no fee costs, to people injured in car accidents involving Toyota vehicles.
The claimants, named as American Automobile Insurance Co., Fireman's Fund Insurance, National Surety Corp., Ameriprise Insurance, IDS Property Casualty Insurance, Motorists Mutual Insurance and American Hardware Mutual Insurance, stated that they sought to recover in excess of $240,000 (US) for compensation they had paid out for 14 separate car crashes, all of which they said could have been avoided had Toyota Motor Corp. managed to install a functioning override system. Such, a system, said the claimants, would have ensured the cars ceased to accelerate in the event of the throttle and the brakes being engaged simultaneously.
A writ stated that "certain of Toyota's cars and trucks have a defect that causes sudden uncontrolled acceleration to speeds of up to 100 mph or more."
However, Toyota sought to defend the claims and released a statement saying that the complaint was "completely unfounded and has no basis".
