One of the mitigating factors in a product liability claim, from the point of view of the manufacturer of a product that has caused a personal injury, is the presence of warnings in the labels or packaging of the product.
If a product is used in a way that may cause injury, in defiance of warnings from its manufacturer that it should not be used that way, then it is understandable that a lawyer defending a claim under product liability law might succeed in doing so on the basis that the injured party is at fault.
