An Appeal Court in London has confirmed that a 57-year-old woman has won her slip accident claim for the injuries she sustained as a result of slipping on grapes in a local shop.
The claimant instructed a personal injury lawyer to launch the slip accident claim after she broke both her wrists in the 2005 incident.
As a result of the ruling the shop has been ordered to pay more than £110,000 in injury compensation.
Although it is understood that the shop had liability insurance, the shopkeeper's son said it is likely that, due to a loophole, the owners will be liable for the full amount. "Sometimes you do wonder whose side the law is actually on," he said.
"The amount hurts. It will be a huge dent to us but what hurts most is the judge's ruling that we may have been careless in our duty to the public," said the shop's general manager.
In making the slip accident claim ruling, the judge ruled that the shop had been negligent in ensuring its duty to protect the public from injury.
