Accidents on a beach

Visiting the beach is usually one of the most enjoyable parts of a holiday. However, there are certain risks that can result in an accident if care isn’t taken to protect those on the beach.

One major risk is linked to sharp objects often found in the sand. Items such as glass, hard plastic packaging, tin cans and hypodermic needles can cause significant injury to anyone who stands, runs or sits on these sharp objects.

Other accidents that commonly occur on beaches include:

  • Drowning and being swept out to sea, often caused by warning signs not being visible
  • Collisions with other people, rocks or the beach itself during kitesurfing
  • Injuries caused playing volleyball and other beach sports

These accidents can cause serious, life-changing injuries and, in some cases, even death. It is important to find out who is responsible for the health and safety of a beach, so if an accident does occur, you know who will be responsible if negligence is the reason for your injury.

Accidents on a holiday park

Many holiday parks, including caravan parks and holiday camps such as Centre Parcs, Butlins and Pontins, have areas and attractions that can place both adults and children at risk of injury. This is why risk management consultants are employed to ensure holiday parks are compliant with the relevant health and safety regulations.

Causes of holiday park injuries and illnesses can include:

  • Slips and trips
  • Vehicle collisions
  • Bicycle accidents
  • Defective and faulty equipment
  • Food contamination issues

If you or a loved one have been involved in an accident at a holiday park that was caused by the negligent actions of a member of staff or a failure to comply with health and safety regulations, you will be eligible to claim compensation for any injuries sustained.

Claims against tour operators

The Package Travel, Package Holiday and Package Tour Regulations 1992 were created to provide protection for people who suffer an injury on holiday but have difficulty pursuing a claim for compensation in the country in which the accident happened. These regulations state that a package deal consists of at least 2 of the following 3 activities booked together:

  • Transport
  • Accommodation
  • An excursion or any other significant activity

The regulations state that if you sustain an injury or illness on a holiday that was organised by a tour operator as part of a package deal, you can make a claim in the UK. Common reasons for a claim to be made against a tour operator include:

  • Injuries suffered at a hotel
  • Injuries suffered on an organised excursion or activity
  • Illness caused by staff negligence or unclean rooms and facilities
  • Illness caused by poorly prepared food
  • Costs incurred for accommodation and food as a result of long flight delays

Our solicitors will be able to investigate whether your tour operator was at fault and will advise on the best action to take.

When can I make a claim?

You can make a claim for an accident that happened on holiday, whether you were holidaying in the UK, in Europe or on the other side of the world. Compensation can be sought for medical expenses, reimbursing travel costs and lost earnings.
