If you have been injured in an accident that wasn't your fault, you could be entitled to make a personal injury compensation claim. This is particularly relevant in the workplace. Whether you work in a factory, a building site or an office, your employer has the responsibility to ensure that your safety comes first.
If you have suffered a work injury because your safety was ignored, you could be able to make a personal injury compensation claim. Over the years we've helped a number of people claim compensation for work accidents and here's what one of them, Mr Allen, had to say.
I was working for the same company for about 15 years and had a really good relationship with my boss; I would even call him one of my closest friends. But somehow I think that by becoming such good friends he ignored certain health and safety aspects and unfortunately for me, I suffered as a result.
I wasn't too sure about making a personal injury compensation claim at first but after speaking to YouClaim, I was reassured about the idea of seeking damages from somebody I considered to be a friend. I went on to explain to the claims advisor how the accident came about.
Working as a marketing coordinator, you're constantly on your feet and with our offices being located in a three-story townhouse, I was always rushing up and down the stairs. About a year before my accident I noticed that the carpet on the staircase was staring to wear and I told my manager that it would probably need replacing sometime soon.
After mentioning the carpet to my boss and with him agreeing that it should replaced, nothing was ever done about it. I kept bringing it up and then one day when I caught my shoe in a tear I reminded him once again to which he replied in a jokey sort of way, "You're not still banging on about that carpet are you? Haven't you got better things to be getting on with?"
For the next few months following that conversation I took careful steps every time I needed to use the stairs and warned all the other employees about it. I never thought that I would be in the position of contacting a personal injury solicitor to make a personal injury compensation claim, but then my accident happened.
One day, when I had to rush downstairs get the post out on time, the worn carpet that had been ignored for so long changed my life completely. I was heading downstairs when the carpet slipped off the step. My right foot went out forward into the air, causing me to fall on my back as I fell down the 15 steps to the bottom.
I was in agony. An ambulance came to the office and I was carried out on a stretcher and taken to hospital. After having a couple of X-rays the doctor confirmed that I had sustained a broken wrist and bruised coccyx. I stayed in hospital for a couple days and returned home with my right hand in plaster. I couldn't move too much and only had the use of my left hand, which was very frustrating.
While at home, I decided to search the internet for companies specialising in personal injury compensation claims and found that YouClaim had the most useful information on their website. I spoke to one of their claims advisors and their reassured me that I would be able to make a claim against my employer.
From that point on, a solicitor handled every aspect of my personal injury compensation claim and all I had to do was visit an independent medical expert who would be able to confirm my injuries. The solicitor approached my boss and put forward the claim, fortunately, he didn't want the case to go to court in fear that it would tarnish the company's reputation and paid out the compensation straight away.
With YouClaim's help, I was awarded a total of £12,500 which included £2,500 for my coccyx injury, £5,000 for my broken wrist and a further £5,000 for my loss of earnings. I'm really grateful to YouClaim, they made a very difficult time in my life a lot easier.
