Employees should never have to suffer an accident at work

Suffering an industrial injury is not only stressful for the victim but for the family too. Employers have a duty of care to their workers and as such should have health and safety precautions in place to reduce the risk of an employee sustaining personal injury.

If a company has trained workers well and correctly enforced the precautions it has in the workplace it should be able to avoid any severe work accidents occurring and any subsequent compensation claims.

It is likely that workers in a dangerous environment will suffer some small injuries, such as scratches and bruises, but they should not have to endure serious injuries which lead to their hospitalisation.

The pain of an injury

A severe injury can be extremely painful and frightening for the casualty and can traumatise them so that even when they have recovered from the accident they still remember their ordeal and have trouble continuing life as normal.

No one should have to go through an experience which causes them physical and mental trauma, and failure by an employer to protect workers from this can result in a fine from the Health and Safety Executive (HSE) and having to pay a settlement to the victim of the incident.

The stress of recovery

As well as the pain they are likely to have to endure while their injuries heal, they may also have to suffer the stress of being in a hospital environment away from family and the outside world for a long time if their injuries are severe enough.

Being in an unfamiliar and sterile environment after a frightening work accident can cause extra anxiety for an individual who is probably already under undue stress.

The lost earnings

While an individual is recovering from their accident, they will probably be unable to go back to work. Furthermore, if an injury is life-changing they may never be able to work again. This is not only stressful emotionally, but financially.

Compensation should take into account loss of earnings and if the victim of the accident was the main household earner the settlement is likely to also take that into account.

Making a claim for industrial injury

Working in an industrial setting is dangerous, but if an employer has trained staff correctly, provided them with suitable personal protective equipment and clothing, and enforced health and safety procedures, no one should suffer any non-fault accidents.
