Making a claim after product-related personal injury

In Britain, where there are stringent rules and regulations in place to protect people from suffering personal injury, the victim of a non-fault accident is likely to be able to make a successful compensation claim.

Poor manufacture

If a consumer has purchased an item which has caused them an injury due to it having been manufactured poorly, then they could make a claim.

During the design process a firm should make sure that the item will be suitable for use by its target audience and will function in the way it is supposed to.

If a children's toy has sharp corners, or a product's plastic casing is the wrong shape and stops some interior mechanics from moving correctly, anyone injured by this unsuitable design could be entitled to remuneration.

Insufficient warnings

Companies have a duty of care towards their customers, and as such they should make sure that there is suitable warning on product packaging or in a leaflet inside the packaging if an item could cause harm.

For instance, firms should not presume that a person will realise that their hairdryer must not be placed in water. Potentially, a user may believe that since the item will be in close proximity to wet hair, it is safe for use in the bath also. If they act on this belief they could be fatally electrocuted.

For this reason, companies must clearly explain how to use items correctly and safely so that they are not found liable in the event of an accident.

Failing to recall a product

If a consumer is harmed after a company has become aware of a fault with a product but has failed to announce a recall for the safety of its customers, victims may claim compensation for their suffering.
