Surgical error compensation after a Never Event

Sadly, medical negligence claims are all too common, and reports variously appear in the media of patients who have been forced to seek surgical error compensation after mistakes during invasive procedures have left them suffering.

In the early part of 2009 the Never Events Framework was published by the NPSA (National Patients Safety Agency) to define a list of "serious, largely preventable patient safety incidents that should not occur if the available preventative measures have been implemented".

The first two events on the list are both surgical errors:

  • wrong site surgery

  • retained instrument post-operation

In October 2010, it was reported that the list was to be expanded and another six instances of "inexcusable" medical blunders were added to the eight previous instances.

Two of the additional clauses involved instances which could occur in many surgical procedures:

  • Death or serious injury from giving a patient the wrong blood or an incompatible organ

  • Giving a patient the wrong gas resulting in a patient dying or being seriously injured

According to press reports, during the first year of the Never Events Framework being in place, 111 instances of medical negligence errors from the original list occurred. A little over 50 per cent of those were surgical errors of wrong site surgery.

As the newly extended list was published NHS Medical Director, Professor Sir Bruce Keogh said, "Never events by their very name should never occur in a modern NHS. The proposed list includes avoidable incidents with serious adverse consequences for patients.

"No one wants these to happen, therefore we will not pay hospitals when these events occur. This will send a strong signal to leaders of the organisation to learn from their mistakes so they don't happen again."

Worryingly, it is obvious that despite the framework and the supposed implementation of the World Health Organisation's Safer Surgery Checklist, in which all theatre staff stop at intervals and run through a set list of checks, the prevention of wrong site surgery is far from complete.
