Incidents of negligence for which misdiagnosis compensation may be payable are surprisingly common in the NHS.
In fact, according to a report by the NHS National Patient Safety Agency (NPSA), as many as one in six, or 15 percent, of NHS patients, whether in hospitals, specialist units of GP surgeries, may have their symptoms misdiagnosed.
What is more worrying is that many experts such as Peter Walsh from Action Against Medical Accidents believe that these figures represent "just the tip of the iceberg", as it is estimated that a very large number of cases go unreported.
Walsh adds, "There is no mandatory reporting of missed diagnoses so the true scale cannot be known.
"There are very few reports to the National Patient Safety Agency (NPSA) and we would like to see it become a legal requirement for all missed diagnoses to be reported."
Imperial Centre for Patient Safety and Service Quality at Imperial College London is an organization which has initiated a great deal of research on the issue of misdiagnosis. A professor from the college comments, "There is absolutely no doubt that this is being under-reported," he said. "But more importantly they are not being adequately analysed.
"Trainee doctors are too quick to judgement, that is one of the problems that we face."
Many cases of misdiagnosis are relatively innocuous, causing no lasting harm – however, some instances, such as those involving cancer can be traumatic, even fatal.
There are a variety of errors that may lead to grounds for a cancer-related misdiagnosis compensation claim, these include, pathology and radiology (53% of cases),communication breakdowns (26% of cases), cancellations (15% of cases) andmistakes in clinical assessment (5% of cases).
