Similarities between silicosis and asbestosis claims

Compensation for an asbestosis claim is likely to be less than that paid for the other well-known asbestos-related disease, mesothelioma. This is because asbestosis is, in itself, not necessarily life threatening. Instead, the disease is characterised by the bronchioles and air sacs becoming contaminated with asbestos fibres, which in turn cause the lung tissue to become fibrotic and less elastic.

In many ways, the disease has more in common with silicosis than it does with cancer of the mesothelium, which is invariably fatal.

Like asbestosis, silicosis is caused by a build-up of dust in the lung – although in the case of silicosis, the dust is from crystalline silica rather than asbestos.

Both industrial diseases are characterised by interstitial fibrosis of the lung tissue, which ultimately results in shortness of breath and may, particularly in cases of continued exposure, develop progressively, resulting in deterioration of respiratory function.

Typically, the two diseases affect workers from similar occupational backgrounds. These may include, mining, boiler-related work, quarrying and manufacturing-related work.

However, for the simple reason that the two illnesses are caused by different substances, silica and asbestos, respectively, there are many occupations where workers are prone to one of the industrial diseases but not the other.

It is true that the pathogeneses of the two diseases are markedly different &ndash: however, it is also true that there are similarities in settlements awarded for the two industrial illnesses.

A spokesperson with no win, no fee compensation specialist YouClaim, comments, "There are strict rules in place governing workers' exposure to both silica and asbestos.

"This is best enshrined in the Health and Safety at Work Act. Furthermore, sufferers of both diseases are entitled to claim 100% compensation if the illness has developed as a result of workplace exposure.
