I was hurt in an accident at work but I'm worried that I'll get fired if I make a claim. Can my employer do this? (LS, Aviemore)

Absolutely not. Your employer has no right whatsoever to sack you if you decide to make a compensation claim against them. Understandably, a lot of people are concerned about this issue but you have to remember that the law is on your side and will fully protect you if your employer attempts to dismiss you.

How long have I got after being hurt to make a claim? (FF, Dundee)

The general rule is that a compensation claim must begin within three years. This is not necessarily three years from when the personal injury was sustained but can be three years from the date that you became aware your injury was related to the original incident.

For example, you may have hurt your ankle and visited hospital the same day only to be told that you'd just badly bruised it. If you went back several weeks later and discovered that it had been broken all along, the three years begin from the date you discovered it was broken and not the day the injury actually occurred.

It is similar with cases of industrial diseases such as asbestosis and mesothelioma as the three year limit begins the day you discover the illness was linked to the exposure. If making a compensation claim following somebody's death, the three years begins on the day they passed away or the day that the incident was known to be responsible for their death.

I was left with whiplash when somebody crashed into the back of my car. How much money will I be able to get if I make a claim? (MK, Inverness)

The amount of money you can claim for really does vary from case to case so it's very hard to name a price. It's not just the pain and the trauma of the whiplash injury itself that you can claim for, but also other things such as lost earnings, medical costs and travel expenses to name but a few.

Saying that, recent compensation claims have seen whiplash sufferers awarded anything from just under £1,000 to as much as nearly £14,000, depending, of course, on the extent of their personal injuries. This is purely for the pain and suffering caused by the injury and any extras (such as loss of earnings) will be added on top.
