Avoid winter road accidents and a compensation claim in Scotland

Although Scottish drivers are used to coping with rain, snow, ice, fog and wind whenever they are driving in the winter, it is still the time of year when many road traffic accidents occur which lead to a compensation claim in Scotland.

Transport Scotland is the government agency which aims to reduce the toll of deaths and serious injuries on the country's roads, where people continue their every-day lives despite poor weather conditions and fewer daylight hours.

The winter of 2009-10 was particularly harsh throughout the UK but since then, Transport Scotland has installed an increasing number of live cameras to check on driving and weather conditions on most major routes. There are now more than 100 of these silent watchers which can relay information to identify problems and keep traffic moving.

As well as providing regular updates to radio stations, Transport Scotland puts the relevant information on its website where live footage can be accessed plus a journey planning tool and details on roadworks which could cause disruption.

Head of network maintenance at the agency, Graham Edmond, says that motorists should think and adapt their driving to meet any conditions they encounter and to gather as much information as possible before setting out on a winter tip.

Driving advice on the Transport Scotland website includes:

  • Check your vehicle is well maintained and serviced, top up anti-freeze and ensure your tires have good tread.

  • Check the weather conditions and let someone know where you are going and when you are setting off.

  • Adapt the way you drive to suit the conditions wet, windy, ice, snow, fog, and low sun are all hazardous and need due care.

  • Be aware of changing conditions, including the light remember to switch on your main beams and be extra aware of others and animals in dusky light.

  • Keep an emergency kit in your car.

The vast majority of vehicle accidents occur between two or more vehicles and, often, with winter weather conditions, it may be almost impossible for a crash to be avoided. However, if a driver has taken every precaution and then finds he is a victim of someone else's lack of care, it may be that damages could be sought by the innocent party from the person at fault.
