Edinburgh injury claims and accidents at level crossings

Too often in and around Edinburgh people, particularly the young a restless, risk their lives and the lives of others by dashing across level crossings even when the barriers are down or about to come down – such recklessness can have serious consequences and may sometimes result in an Edinburgh injury claim.

However, there are also issues about the safety of open level crossings, with rail bosses potentially liable for any injuries sustained at hazardous sites.

The pregnant woman's claim
In 2010 a Scottish woman made an Edinburgh injury claim for the multiple injuries, including a head injury, a fractured pelvis and a broken shoulder, she sustained in a 2002 level crossing accident.

She had been two months pregnant at the time and had failed to see the level crossing warning lights, she claimed, because of strong low sunlight and rain. Fortunately, her unborn child survived unharmed and was born seven months later – however, she sought to claim £800,000 for the injuries she sustained in the incident.

Open level crossings and near misses
Although open level crossings represent just one in fifty of all level crossings in Scotland, they account for a disproportionate number of accidents, with many people in cities and towns such as Edinburgh saying that they feel unsafe using them.

In 2010 more than 800 people sent a Scottish minister information about accidents and near misses they had been involved in at open level crossings in the country.

One of these commented, "How many people have to die before adequate safety measures – barriers – are installed? Cameras are not a safety measure, and you cannot prosecute a dead person.

"I find it absolutely extraordinary that open level crossings are allowed at busy crossings. The only reason for not installing barriers is money. What price is people's lives?"
