The Working Time Directive may affect Scottish accident claims

Fire services often attend the incidents that are responsible for Scottish accident claims, such as car accidents and industrial incidents.  However, worries have been expressed that remote areas in Scotland may not be able to rely on this if the European Working Time Directive is implemented without appropriate thought.

The Directive, which has been contentious since coming into force in 1998, reached a compromise in the European parliament in 2008, which in many cases, as the Government insists, "allows the UK's vital labour market flexibility to continue, while ensuring workers are treated fairly."  However, the many part-time retained firefighters that respond to accidents in Scotland may be restrained in the number of hours they can work under the Directive because they have other jobs for the rest of the week.

If this were to be the case, compensation claims in Scotland could rise, as there may be more personal injury and other damage suffered by people in remote locations if the fire service cannot reach them due to restrictions on hours to be worked.

A spokesperson for the Chief Fire Officers' Association in Scotland said this possible reduction in service "represents a significant threat to the wellbeing of people across Scotland."
