Making a no win, no fee claim after a motorcycle accident

Scotland provides a unique and breathtaking terrain. All motorists who've experienced Scottish roads, including motorcyclists, will recognise this. Most will probably also recognise the relatively high danger of suffering a motorcycle accident in Scotland.

Troublingly for both bikers and Scottish legislators, while mono win no fee solicitors, motorcycle accidentst of the 2010 "Tomorrow's Roads Safer for Everyone" targets are on course to be met, there has been a rise in the number of people killed or seriously injured in motorcycle accidents on Scottish roads.

In 2004 alone there were 986 serious motorcycle accidents in Scotland; of these there were 389 motorcyclists who were either killed or seriously injured. Overall, since 1996 there has been a 9% rise in the numbers of fatalities and casualties from motorcycle accidents on Scottish roads.

The risk to motorcyclists travelling on Scottish roads is clear. Statistics from the Department for Transport show that, for every mile travelled, motorbike riders are at 25 times greater risk of being killed than car drivers, and five times more likely to be killed than cyclists.

Clearly, this presents a disturbing picture of biker safety in Scotland. In recognition of this the Scottish Government has made a series of recommendations designed to reduce the incidence of motorcycle accidents in Scotland.

Reaching out to riders
In an attempt to better understand motorbike riders so as to be better able to communicate with them, the Scottish Government conducted a series of extensive interviews and questionnaires with Scottish riders.

It seems that their findings were at once optimistic and confusing. They found that there was no single all-encompassing description of the "typical" Scottish motorcyclist.

What they did find was that the vast majority of Scottish motorcyclists are well informed about risks, accept them and would be unwilling to quit motorcycling because of them.

In our experience, even when a motorcyclist has had to make a no win, no fee compensation claim for the personal injuries he or she has suffered in motorbike accident, he or she is still keen to return to the saddle as soon as possible.

So clearly, there is not a great deal of use in discouraging motorcyclists from the road so, sharing this view, the Scottish Government campaign will focus on educating riders rather than targeting them for censure.

Among their recommendations are goals for promoting rider safety, redefining the definition of "a good rider" and an emphasis on more pre and post-test training.

It goes without saying that these measures will not work without other campaigns designed to prevent motorcycle accidents directed at drivers of other vehicles. Luckily, it seems that this is the approach of the Scottish Government.

It can only be hoped that these changes will bring about a reduction in the number of motorcycle accidents causing death, personal injury and no win, no fee claims.
