It is only possible for a person to secure compensation for a defective product if it can be proven that there is a causal link between a particular product and the injury or illness that has been suffered by a claimant.
In 2010 the US suffered one of the most major food safety scares in its history when some 228 million eggs were recalled as a result of fears concerning mass outbreaks of salmonella poisoning.
Although here in the UK there was a scandal when in 1988 the then health minister Edwina Currie claimed without substantiation, "Most of the egg production in this country, sadly, is now affected with salmonella", cases of salmonella poisoning arising from infected eggs are relatively rare. This said, salmonella egg claims are made on a yearly basis.
For example, only weeks before the mass egg recall was initiated in the States, inmates at Wandsworth Prison in London were given hope of receiving a combined £500,000 in defective product compensation after the Ministry of Justice conceded that it was responsible for an outbreak of salmonella that had affected more than 300 prisoners who had eaten egg mayonnaise sandwiches. The Health Protection Agency confirmed this view. The cause, said an HPA spokesperson, was "badly cooked eggs".
A prison "insider" told a newspaper, "It affected about 300 of our prisoners and quite a few of the prison wardens.
"They suffered from stomach cramps, vomiting and diarrhoea and had to be seen by the prison doctors."
A spokesperson from YouClaim commented on the case, "Although exceptional because it was a prison-related case, in all other respects the salmonella outbreak at Wandsworth Prison was typical of the kinds of poisoned food product cases that no win, no fee solicitors regularly deal with."
