Product liability law information shared across Europe through RAPEX
RAPEX is the European system for the rapid exchange of information about dangerous and faulty products around EU countries, and is therefore likely to be of interest to anyone making a compensation claim under product liability law.
A European Union directive states that "The rapid exchange system comes into operation when a product is shown to present a serious and immediate risk for the health and safety of consumers. This risk is assessed on a case by case basis by the national authorities."
Each country that is involved in the scheme has a central point of contact, who will send any relevant information about products that endanger European citizens to each of the other countries' point of contact - and receive them in turn. In the UK, this role is held by BERR, the Department for Business Enterprise and Regulatory Reform.
Thus, a significant faulty product compensation claim may qualify as a "serious and immediate risk" for the RAPEX system to inform its members of; its members would then publicise this information in their own countries.
Since 2007, the system has also been making connections with China and the USA.
Product liability issues dealing with food, drugs and medical devices are not covered by RAPEX, as these types of product have their own systems for distribution of information within Europe.
