In increased efforts to drive down the number of product liability claims and product liability compensation claim payouts, manufacturers are reportedly issuing more product recalls than ever.

In the US, 2007 was dubbed 'the year of the recall' with 472 voluntary product recalls completed by November. As a consequence, the US Consumer Product Safety Commission (CPSC) has pushed through sweeping CPSC reform legislation which will improve product safety requirements and reduce the economic effects of product recall and product liability compensation claims.

In the UK, research carried out by European risk management and PR experts Razor has revealed that UK consumers rarely take notice of product recalls or believe manufacturer's claims of trustworthiness.

These findings may be partly due to the increase in product recalls over recent years. However, manufacturers are caught in a catch-22 situation, as 2005 product safety legislation ruled that companies have a mandatory obligation to inform consumers and authorities of any potential risk to consumers if their product is in any way faulty.

The research also showed that consumers were more likely to take advice from the media regarding a product recall than to listen to the advice of the manufacturer. For firms that have built up brand reputation over many years the effects of a high profile product recall can cause major damage to their market share in terms of sales and loyalty.

For manufacturers the question of losing customer loyalty due to product recall or the backlash from media coverage of a product liability claim is obviously a harsh and fearful spectre to contemplate.

A product liability claim spokesperson said, "One would hope that fear of business loss from product recall or product liability compensation claims would garner greater emphasis on high manufacturing standards. However, until businesses fulfil their responsibility to supply safe goods to their customers, product liability claims are here to stay."
