The Consumer Protection Act of 1987 is the main piece of product liability law pertaining to small part choking hazards. For example, under the act any product sold in the UK must be advertised and presented in such a way as to be targeted at an appropriate age group.
This means that those at most risk of choking - children under 36 months - should never be identified as the consumers of a product that is likely to pose a choking risk to them.
Also covered under the act is the way instructions should be written. They must be clear, concise and accurate, and in cases where the product is manufactured in another country, should be translated to native speaker standard.
Small parts can not only be put into the mouth; they can also be inhaled or placed in the ears, nose or eyes.
It is also worth noting that soft substances such as the stuffing from cuddly toys or the hair from dolls can also constitute a choking hazard, meaning it is always advisable parents check that the product is suitable for their children.
Unfortunately, in cases where the toy is defective or the manufacturer or seller have not properly labelled the product for age-suitability there is little parents can do to guard against the risk other than closely monitoring their children's play.
