The 2011 equipment failures, nuclear meltdowns, and releases of radioactive material at Japan's Fukushima I Nuclear Power Plant were part of a much larger tragedy following the Tohoku earthquake and Tsunami – however, it also raised a number of pertinent product liability law issues for lawyers and consumers in both Japan and the wider world, particularly with regard to foodstuffs and cosmetic products.
Contaminated cosmetic products
A high proportion of beauty and cosmetic products sold on the European market come from Japan. As such, on April 22nd 2011, following the Fukushima nuclear accident, the General Directorate for Health and Consumer Protection asked AFSSAPS (The French Agency for the Safety of Health Products) to consider the potential hazard of cosmetic products imported from Japan, together with risk posed by the raw materials of which they are composed. However, it stated that up until that point there had been no record of any "contamination of non-food products".
Liability
Here in Britain, the situation is much as in France: any person or organisation that places a product for sale to the general public has a responsibility to ensure that it is fit for human use or consumption – this obligation includes ensuring that products are free from potential radioactive contamination, even if this has occurred as a result of a large-scale nuclear accident.
Contaminated foodstuffs
In the months following the Fukushima disaster radioactivity was recorded in a number of Japanese foodstuffs, including some which had been exported to other nations.
Foodstuffs affected included parsley, rapeseed, mustard and perilla. However, with concerns for both consumer safety and the potential implications for product liability law action, governments and health agencies were quick to intervene.
UN Agencies, including the International Atomic Energy Agency, the World Health Organization, and the Food and Agriculture Organization issued a statement to this effect: "Food monitoring is being implemented, measurements of radioactivity in food are taking place and the results are being communicated publicly".
