Information about mislabelling of food products and product liability law


When a person chooses to buy a product, they expect the item to fit the descriptions on the packaging, however, some manufacturers fail to put the appropriate warning signs on their products which may cause a person to sustain a personal injury and consequently claim compensation under product liability law.

Many people are unable to eat certain ingredients, whether this is due to food allergies and intolerances, or down to a lifestyle choice. A customer who needs to find out whether a food is suitable for them to consume will often refer to the packaging where the ingredients will be stated.

However, if food packaging does not display the correct ingredients, or is advertised not to contain an ingredient which it actually contains traces of, the food could potentially cause a serious personal injury.

For example, if a person suffers from gluten intolerance coeliac disease, and they purchase an item with a label which states that the product is gluten free, a severe reaction may be experienced when the food is consumed as the gluten cannot be processed. In some cases, mislabelled food may cause a person to be hospitalised.

Products which contain nuts must also be labelled very clearly as nut allergy sufferers can experience anaphylactic reactions, such as narrowing of airways which causes severe breathing difficulties.

These reactions can be very distressing and even life threatening, and if the product has been mislabelled, the victim may have grounds for a product liability case.

Other items which must be labelled include fair trade items, vegan products, organic products, and freedom food products.
