When a company makes a product recall notice it is usually to prevent the possibility of many product liability claims for compensation which can be financially disadvantageous and damaging to the brand. But, in 2010, a major electronics manufacturer put out a curious recall notice which appeared to be a plan to not only protect themselves from litigation, but may also have helped the sale of new products.
The manufacturer put out a product recall notice on 20-year-old TVs, stating that "a particular inner component has been found in some cases to suffer age deterioration following very long term usage and thus overheat. This overheating may, in rare cases, cause the component to catch fire and result in a burn to the TV set, and possible damage to surrounding property".
The company stated that, in the light of this fact, owners of certain TVs manufactured before 1990 should stop using them and dispose or recycle them appropriately.
The company revealed a list of 200 affected model numbers and customers were urged to check their equipment. Apart from mentioning that some retailers may offer a trade-in discount when purchasing a new TV, no offer of a refund or discount on new equipment was offered by the manufacturer.
It appeared to some sceptics that a product recall notice for 20-year-old electrical equipment could be seen as corporate self-protection in the extreme – if a customer attempted to make a product liability claim after the product recall notice had been issued, a court would probably see the notice as mitigating in the manufacturer's defence.
Cynics also saw the move as ever-so-slightly scare-mongering in its nature and the recall notice could have been seen as an attempt to increase sales of TVs. Whilst it could not be guaranteed that customers who felt it necessary to dispose of their old set would choose the same brand when purchasing new television equipment, if owners chose to heed the warning, then TV sales would be boosted in general.
