The Chinese drywall product liability claim scandal

In recent years, one of the biggest product liability claim scandals to the hit the United States has concerned Chinese drywall, a gypsum-based plaster building material imported from China during the height of the housing boom in 2004.

Although drywall is not harmful in itself, the problem with the Chinese drywall is the presence of harmful chemicals which produce sulfurous gases such as carbon disulfide, carbonyl sulfide, and hydrogen sulfide.

The emission of these gases, which increases with rises in temperature and humidity causes copper surfaces to turn black and results in a variety of health conditions for occupants, including sinus problems, nosebleeds and respiratory tract infections.

In the US, Chinese drywall has resulted in several multi-million pound product liability claim settlements. One of these settlements occurred in 2010 when a judge awarded $2.6 million damages to seven Virginia families affected by Chinese drywall-related problems.

Such damages decisions have resulted in businesses becoming more vigilant about ensuring they have sufficient environmental liability cover.

"It's as innocuous a material as you can have it's just paper with Gypsum sandwiched between it and yet here we are a couple of years later and it's become the biggest products pollution issue in North America in the last decade. If you make a product it's a good idea to maintain some level of pollution liability cover because who knows what the next Chinese drywall will be," said one expert.

"There's a culture of environmental awareness going on right now and it's really changing the way businesses think," he added.

"It's the cumulative effect of asbestos litigation in the 1980s and mold litigation in the early 1990s. Chinese drywall is an issue now and global warming is becoming an issue.

"It's a history of these environmental issues becoming very prominent and people seeing the potential downside to their businesses if they don't try to protect themselves from that liability."
