Carbon monoxide poisoning can be fatal, depriving the blood of the ability to transport oxygen and resulting in the failure of the body's internal organs. Carbon monoxide poisoning is difficult to spot, as carbon monoxide is both odourless and colourless. Sometimes, in the event the poisoning has been caused by a faulty product, it may be possible to make a product liability claim against the manufacturer of that product.
In the past, people affected by carbon monoxide poisoning have enlisted no win, no fee solicitors to claim compensation from the manufacturers of faulty products.
Whether boilers, cars or some other kind of gas-emitting appliance, in the event it can be proved that death or injury has resulted because of a product fault or defect, compensation should be payable. Furthermore, compensation may also be payable in the event that a manufacturer or seller has provided inadequate instruction about the safe use of a product,
This reality was highlighted in 2008, 2009 and 2010, during which time at least six people suffered carbon monoxide poisoning after complications relating to the use of a grill function resulted in a fatal build-up of gas.
This build-up of gas occurs when the grill door is closed when used. Yet, because the manufacturer's instructions advise against use in this way, those who have lost loved ones in these circumstances may find it impossible to make a product liability claim.
However, bereaved family members, consumer groups and health and safety organisations have expressed anger at what they perceive to be an unfair legal technicality. "The rules say the manufacturers are covered because the instruction manuals say to keep the grill doors open. But how many people have read the instructions for the cooker they used to make dinner last night?" Commented a spokesperson.
"Many people, like students, inherit gas cookers without a manual when they move into rented furnished flats, or if the cookers are bought second hand. It's horrifying that such a simple error as leaving a door closed can have such fatal consequences. It is so obviously a design flaw."
While one man, who lost his parents to grill-related carbon monoxide poisoning, commented, "You can't prepare for that sort of thing. When you hear about carbon monoxide poisoning you think it's from boilers or fires, nobody thinks about cookers.
"I think this shows grill ovens should be fitted with a safety device to switch it off if the door is closed, just like when you close the lids on hobs.
"I don't suppose my parents read the instructions because everyone thinks they know how to use a cooker. If I'd known they had something wrong with the main oven we would have had it sorted."
