In 2009 General Motors went bankrupt. However, the GM brand, which is responsible for Vauxhall, is set to stay alive by selling its assets to a new company. For a while this caused concern, as it seemed that any New GM would seek to absolve itself from all product liability claims relating to Old GM vehicles.
However, following pressure from consumer advocacy groups who threatened to oppose any sale on these grounds, it has been confirmed that the New GM will be prepared to pay compensation stemming from any future product liability claims for Old GM cars.
This decision has been hailed as a "significant triumph" for consumers who previously faced the difficult prospect of trying to claim damages from Old GM, a company which is now little more than a collection of liabilities and unprofitable assets.
A spokesperson from the The Ad Hoc Committee of Consumer Victims of Chrysler and GM welcomed the development, saying, "The fact that New GM will protect consumers injured by defective Old GM cars is a positive development for public safety."
However, many remain disappointed that the deal did not go further to ensure claimants receive justice. As it only applies to future claims involving Old GM vehicles, those claimants whose cases are already pending face many months of anxious waiting to see if their no win, no fee claims will succeed.
