Product liability claims, heart defects and SSRIs

Some would say that at no time is life more precious or more tenuous than when it is in the womb. With this in mind, the modern day mother-to-be is both careful and vigilant about what she does, what she eats and what medicine she consumes. Many also keep up to date with the advances in pregnancy-related science and read all about the latest recalls so as to avoid both injury and becoming involved in a product liability claim.

Despite the care and attention to detail of mothers-to-be, there are incidents, where no matter how much they might try and protect their unborn children, things happen that are out of their control.

Typically, this will involve some form of negligence, accident or product-related issue that might result in a product liability claim.

For example, a number of anti-depressants belonging to the type called selective serotonin reuptake inhibitors (SSRIs) have been shown to double the risk of a particular kind of heart defect in unborn children, especially if taken in the first trimester of pregnancy.

Sertraline, citalopram and fluoxetine (Prozac) are just some of the drugs belonging to the SSRI class that studies, most notably a 7-year-long Danish study, have shown to be harmful.

However, the risk inherent in these drugs is relatively small. For example, one in 250 children born to mothers not taking the drug are born with the defect; for mothers taking the drug, the figure is two in 250; the figure is four in 200 for mothers who take two or more SSRIs. In fact, experts say that some SSRIs may increase the risk of persistent pulmonary hypertension by as much as a factor of six.

It is not unheard of for no win, no fee compensation to be paid out to families after children have developed heart defects as a result of SSRIs. In 2009 a $2.5 million settlement was paid to an infant who suffered a heart defect in these circumstances.

There may also be other complications associated with these drugs. As reported in the American Journal of Obstetrics & Gynecology American researchers have found that of 3,000 women who gave birth in one study, the rate of premature birth was significantly higher in those who had started a course of SSRIs during the second or third trimester of pregnancy.
