A list of product recall notices is constantly available on the Trading Standards Institute (TSI) website and any company which wants to advertise a recall on the site can email the TSI. Advertising a product recall can reduce the number of product liability claims made against the manufacturer.
According to a UK law firm, which has been collecting data on recalls since 2005, from November 2009 to November 2010 a record high of 229 product recalls were made in Britain. This may not necessarily have been because of a decline in the quality of manufacture, but instead an increased awareness among companies of health and safety risks and compensation claims.
Personal injury claims made against a firm can have a detrimental financial effect on a business, and also damage their reputation. Therefore it is within a company's interest to protect its customers from harm, and recall faulty products as quickly and efficiently as possible.
All sorts of merchandise, from babies' push-chairs to international plug-in adaptors, from hair straighteners to children's foldable scooters, can and have been recalled in the past, but unfortunately businesses often only become aware of a dangerous fault after someone has already suffered personal injury from using the defective product.
Babies, children, adults and even pets can be harmed by an item which has been poorly designed or badly made and if it results in severe injury, or death, victims are likely to try to claim compensation for a reduced quality of life and any loss of earnings.
Typical product recall procedure
After a potentially dangerous product is identified, a full risk assessment is undertaken by the company to evaluate how great a chance there may be of accidents occurring as a result of the merchandise.
Data such as how many units of the item have been sold and whether it is still in production, are taken into account and a decision made as to whether the risk is great enough to issue a recall.
If there is enough of a risk to customers, information necessary to identify the recalled item, such as sell-by-dates, product or batch numbers, is sent to retailers which sell the product so that it can be removed from the shelves.
Circulation of the merchandise is frozen and the company decides whether to replace or modify the item, or offer refunds to customers who have already purchased it.
