Product liability Claim compensation after a Chinese sky lantern injury

Chinese lanterns are a beautiful and magical sight when they go up into the night sky, but unfortunately some people have had to make a product liability claim after using one.

Historical documentation of the first Chinese lanterns can be found from over 2000 years ago. They were originally used to send signals to troops or other military convoys which were far away. Nowadays, however, the use of sky lanterns for celebrations, such as on Bonfire Night or at a wedding, is their most common employment and has become very popular.

How do Chinese sky lanterns work?
Sky lanterns work in the same way as hot air balloons and are built in a similar fashion to flat-pack paper lampshades.

To reduce the risk of the lantern itself catching alight, it is made of special non-flammable paper.

Once lit, the lantern will fill with hot air and rise up into the sky to about 1,000 feet – that's 300 meters.

Most remain lit for 5 minutes or longer, and if there is a breeze they can drift over two miles.

After the candle goes out, the air inside the lantern cools slowly and the lantern descends little by little until it lands.

Safety tips

  • In wind speeds above 5mph, a lantern should not be used, as it could fall from the sky.

  • A lantern should not be lit and released anywhere in a 2 mile radius of a main road or an active air-field.

  • Depending on the size of the lantern, it may be wise to have more than one person holding it while it is being lit.

Chinese lantern accidents in 2010
Chinese sky lanterns can be very dangerous. In 2010 there were several young children who suffered Chinese lantern related injury though no fault of their own, and faulty product liability claims could have been pursued.

A three-year-old boy experienced terrible burns to his face, and was nearly blinded in one eye, when a lit candle holder fell from the sky, spilling hot oil onto his skin, as he and his family watched a lantern's release.

Another accident occurred when a boy of 11 years of age suffered burns to his mouth, neck and chest, when one of the lanterns the family had lit, fell from the sky and hit him. The boy was at risk of permanent scarring and the mother described how, just before the lantern fell, she saw the candle tip to one side as if broken.

Instructions should always be provided with Chinese lanterns. If they are not, then the manufacturer may be found liable if someone receives an injury as a result of a lantern's use.

If instructions are provided and followed but someone still receives an injury, then the victim may make a product liability claim and try to gain compensation for personal suffering, be it mental or physical, if the product is deemed to have been badly made, designed or faulty.
