A product liability claim may arise from use of sub-standard car parts

Car manufacturers are occasionally in the news when a fault, or potential one, is discovered in particular models and they are recalled for modification or replacement before someone is hurt as a result or they make a product liability compensation claim following an incident.

New or nearly new vehicles are the ones which come into this category where they usually still belong to the first owner and have been supplied and serviced by a main dealer of the brand of car since purchase.

Owners are contacted directly or advertisements are placed in the Press and the vehicles returned to the dealer or service depot for the safety work to be completed. These measures should then prevent accidents or reduce potential problems and are part of the motor industry's continuing research and upgrading of their products.

It can be a different story, however, with older and second hand vehicles which may have had a number of owners and an ever-lengthening record of maintenance and repairs.

Some owners only use approved service agents for their type of vehicle, keep to rigid service intervals and have repairs made using only officially-manufactured parts. However, they are a minority and most car-owners these days find it is too costly or impractical to keep to this regime.

Many non-branded parts are interchangeable between models of cars and, if bought from a reputable motor factor company or major retailer, are unlikely to be troublesome and, so long as they are compatible, which can easily be checked through a computer or handbook, should be just as safe and practical as the brand manufactured item.

However, cash-strapped drivers can be tempted to look for second hand, non-brand parts or to try modifying something which does not quite fit. In those circumstances, there is a much greater chance of a problem occurring later and, possibly, the car going out of control or having a crash because of malfunctioning equipment.

This can be particularly true of tyres, with so-called remoulds being particularly susceptible to weaknesses which may only become apparent when the car is in a critical situation such as heavy braking in wet weather.

If a do-it-yourself car repair results in an accident and personal injury to the driver, passengers or other road users, the question of fault may lie with the victim of the accident, however, if they were unknowingly supplied with a sub-standard part which failed, then the supplier of that part could well be liable for any subsequent claim for damages.

Occasionally, unscrupulous garage mechanics use non-standard replacement parts when making repairs or bodge a job either to save money or in order to get it finished quickly and the unsuspecting driver could be at risk of an accident if a component fails.
