Product liability claims and concerns over common chemical

Although there is not yet sufficient evidence for anyone in the UK to commence a product liability claim over the chemical, it has emerged that Bisphenol A (BPA), a chemical most people are exposed to on a daily basis, may play a part in increasing a person’s likelihood of developing heart disease, diabetes and liver conditions.

The link was discovered by scientists at Exeter University and reported in the Journal of the American Medical Association. And although no clear causal link has been established between the chemical and the development of disease, the scientists did report that people with high levels of BPA in their bodies had much higher rates of heart disease, diabetes and liver conditions.

For example, by examining urine samples, the scientists were able to establish that people with higher-end levels of BPA in their system had three times more chance of developing heart disease than those with lower-end concentrations. A similar risk factor was established for diabetes, with the likelihood of developing the disease 2.4 times higher in people with higher levels of BPA.

The report in the Journal of the American Medical Association was accompanied by an article in which two prominent scientists called for “aggressive action” to be taken in order to reduce the scope of BPA exposure.

While David Coggon, from the University of Southampton, commented, "If low-level BPA were confirmed to cause disease, there would be a need to review controls on sources of exposure to the chemical."

If, indeed, a clear causal link between BPA and these diseases is proven, it could well precipitate a deluge of product liability claims, as concerns about the chemical have existed for several years now. For example, just this year Health Canada called for the chemical to be banned there after several studies found it to be harmful to animals.

BPA is used in a variety of everyday products, including: baby feeding bottles, water bottles, plastic toys, electronic equipment, canned and tinned food and drink, and plastic storage containers.
