When consumers buy a product intended to protect them from potentially life threatening risks they are placing their safety in the hands of manufacturers and it is the product liability cases associated with such devices and products that are of great concern to product liability lawyers.
In May 2009, the Trading Standards Institute carried a product recall notice regarding a branded carbon monoxide alarm; quality control batch tests had revealed a potential failure of a particular model number to "detect certain concentrations of carbon monoxide".
Product liability fuels carbon monoxide poisoning
Approximately 50 people a year die as a result of carbon monoxide poisoning in their homes and the merchandise recalled because of a fear of product liability claims is the type of device designed to reduce this number.
Carbon monoxide is the result of incomplete combustion of petroleum or natural gas. Once it is inhaled it inhibits the body's ability to carry oxygen through the blood, thus effectively causing oxygen starvation to organs and cells.
In the home, carbon monoxide is most commonly caused by faulty central heating systems, gas fires and appliances. When these items combine with blocked flues and chimneys and inadequate ventilation the concentration of odourless and colourless gas builds up and is inhaled by inhabitants of the building.
Mild carbon monoxide poisoning is fully treatable by taking the patient away from the source. However, more severe exposure can result in fast and irregular heartbeat, hyperventilation, confusion, drowsiness, difficulty in breathing, followed by seizures, loss of consciousness and eventually death.
