A crane collapse in Croydon badly injured the operator, but after the plant hire company responsible for the safe construction of the unit were found to have breached health and safety regulations it was likely they would also be responsible for paying out crane accident compensation to the injured worker.
The firm were fined £100,000, plus £33,000 in costs for the crane collapse, which happened in June 2007, and the injured worker soon instructed personal injury solicitors to fight on his behalf for work accident damages.
The accident occurred as the crane was being jacked up, but it was found that the crane's cab had not been secured in place before the manoeuvre which would have allowed the extension of the crane's mast.
The cab, which was over 200 feet in the air, toppled backwards and crashed down 40 feet to land on a neighbouring hotel. The cab became embedded in the hotel's top floor and it took over two hours for rescuers to reach and free the operator.
The crane accident left the worker with career ending injuries. His right shoulder blade was smashed, he broke three ribs and fractured four vertebrae in his spine. His skull was fractured, he suffered lung bruising and his entire body was covered in cuts and bruises.
The injuries required him to undergo several operations to rebuild his shoulder and the father-of-two was left able to only walk short distances.
The plant hire company was prosecuted by the Health and Safety Executive (HSE) for failing to ensure the crane equipment was adequately examined after its installation and for failing to ensure the on-site supervisor had the required training to safeguard workers from exposure to risk.
Company representatives admitted breaching regulation 9(2) (b) of the Lifting Operations and Lifting Equipment Regulations 1998; regulation 9(2) of the Provision and use of work Equipment Regulations 1998 and; section 3(1) of the Health and Safety at Work etc Act 1974.
With the HSE prosecution concluded and the plant hire firm having been found accountable, it would be the worker's civil right to pursue a claim for personal injury compensation.
