What happens when a personal injury lawyer loses your case?

Whenever the victim of a work accident, a holiday injury or a car crash considers hiring a personal injury lawyer to make a compensation claim, he or she is likely to be filled with righteous indignation at having been hurt through someone else's fault, and will naturally assume that a win is inevitable.

However, UK law is such that this cannot be assumed. It's therefore important to ensure that, before you engage your no win, no fee solicitor, you trust their skills and their assessment of your case's strength.

If a compensation claim is lost, there are certain possibilities that may result. Your opponent's legal team may be able to charge their fees to you; to avoid this, ATE insurance should be taken out, which will cover these or similar fees. You may also be asked to pay disbursements, which are fees that the other side has been forced to pay (for example, to acquire medical reports). Again, ATE insurance should cover you for this.
