Since Legal Aid for personal injury legal actions, such as most of those relating to compensation for victims of work accidents, car crashes and product liability, was stopped and the no win no fee system started in the UK, the work of the personal injury solicitor has come under increasing scrutiny from the media.
There has been criticism of lawyers being awarded "success fees" when they win a case for their clients and these fees must be paid by the person, company or organisation found to be at fault as well as any damages sum negotiated or awarded by a court.
At the beginning of 2011, the well-known model Naomi Campbell won a case against the Daily Mirror when the newspaper was ordered to pay £3,500 compensation for breaching her privacy by writing certain articles about her and publishing photographs of her.
The court also ordered the paper to pay the legal costs of about £1 million, which included a success fee of more than £365,000 for the model's lawyers. However, the Mirror protested to the European Court of Human Rights both about the outcome of the case and the amount of fees.
Although they did not dispute the original court ruling, the Human Rights judges said the wealthy model was not the kind of person for whom the "success fees" scheme had been devised and the costs imposed were disproportionate.
After the case, the chief executive of the Association of Personal Injury Lawyers (APIL), Denise Kitchener, said it was impossible to compare the case of a wealthy celebrity suing for libel or breach of privacy with a seriously injured person whose life had been shattered by negligence of someone else.
She added that no win no fee was often the only option for a victim of a road accident or work-related injury to achieve fair compensation and justice. This was especially true if the accident prevented the person returning to their previous employment.
