Despite persistent beliefs in the "compensation culture", research undertaken in 2009 by a firm of personal injury lawyers indicates that most people are likely to resist the idea of making a claim that they may be entitled to.
The research, which focused on accident at work claims, found that most people would expect a smaller amount in damages than a judge might award them - giving as an example the fact that three out of five people expected less than £5,000 for an arm fracture (and two in five less than £2,000) when the average award is around £6,000.
Although 90 percent of people expressed a belief that people should expect compensation, many expressed the belief that pursuing a personal injury claim might lead to them losing their job. It is relevant that this survey was undertaken during the 'credit crunch', of course.
A managing partner of the personal injury solicitors firm that undertook the research said, "Not only are most compensation awards unspectacular, but most people actually have very modest expectations - typically in line with average awards or even expecting substantially less. Most people only want fair and reasonable compensation [...] In fact our experience is British people are too stoical".
A good personal injury solicitor will be able to discuss such fears with people considering a claim, without exerting any pressure on the potential claimant to make a claim they do not feel comfortable with.
