Non-fault soft tissue injury and receiving compensation

People, who have suffered a soft tissue injury (STI) through the fault of a negligent employer, a personal trainer, or in a non-fault road traffic accident, could make a compensation claim for their pain, and any resulting loss of earnings.

STI's are damage to muscles, ligaments, or tendons, and as a result this sort of injury can occur anywhere in the body and cause great discomfort and stress to the victim.

Many people's experiences of soft tissue injuries are likely to be just minor sprains, but the damage can be much more severe in some circumstances.

Soft tissue injury categories
Mild injuries of this sort are known as first-degree injuries. These commonly result when ligaments or the joint's capsular structures are stretched, or the muscle suffers a blow. This can result in swelling, bruising, and can cause pain when the injured area is stretched or contracted to its full range. Usually the joint is stable and there will be no loss of function, despite there potentially being some light muscle spasm.

Moderate STI's are known as second-degree injuries. Similarly to first degree injuries of this type ligaments or joint structures have been over-stretched or muscles have suffered a direct blow, but to a slightly more severe degree. Again, swelling and bruising are likely to appear, but in moderate injuries pain will be felt during any movement of the damaged area, the joint may be slightly unstable, muscle spasms are typically stronger, and function may be impaired.

The most severe soft tissue injuries are known as third degree. Serious over-stretching of ligaments or a heavy blow to the muscle can result in a full tear of that area. Pain is often severe, even at rest, and swelling and bruising is much more pronounced. The function of the damaged area is commonly severely impaired, with the joint being unstable and harsh spasms being suffered by the victim.
