Scooters, sometimes called micro-scooters, are fun, but they can also be dangerous and scooter accidents can cause serious personal injuries.
Indeed, it was in 2000 that this reality became clear with the scooter accident death of a nine-year-old boy from Liverpool.
Annual hospital admissions for scooter-related injuries regularly surpass the 2,000 mark. However, there are few regulations pertaining to the use of scooters and, many would argue, none that are specific enough.
However, there is some protection under the Toys (Safety) Regulations 1995 and the "Essential Safety Requirements", as well the possibility of making no win, no fee claims under the terms of the Product Liability (Part l Consumer Protection Act 1987).
But none of these instruments is of any use in launching a claim for civil damages for injuries sustained in road accidents not caused by any product fault or defect.
One thing is clear though, scooters should never be used on the road. The Royal Society for the Prevention of Accidents comments, "Children and adults should not ride these scooters in the road, under any circumstance. They should not cross the road on them, as motorists do not expect to find them on the road and can be easily surprised. Children are not in full control on these scooters, most of which do not have brakes.
"In 1998, 2,200 people in the UK were involved in accidents involving children's scooters. If you consider this was before the craze started we... have a problem on our hands."
