Road accident compensation, cyclists and helmet cameras

It is interesting to note the bad reputation which cyclists hold among some members of the public. However, it is also interesting to consider research which indicates that cyclists may be responsible for only a minority of incidents in which they are involved, typically meaning that they are the party entitled to receive road accident compensation.

This, at least, was the picture painted by a study conducted by researchers from the Monash University Accident Research Centre and the Amy Gillet Foundation.

The study, which took place across three years, looked at a total of 54 road traffic accidents and concluded that in 88 per cent of cases the cyclist was travelling in the correct, legally-prescribed way.

Using helmet-cam technology, in which cameras were mounted onto the helmets of cyclists, the researchers were able to establish that 70 per cent of the accidents observed were caused by driver negligence, either through failure to look or failure to indicate when changing lanes.

Commenting on the findings of the study, Tracey Gaudrey, from the Amy Gillet foundation, said, "We believe there is a strong argument to introduce a road rule that prescribes a safe passing distance (at least one metre), as well as further educating drivers that they need to indicate at least five seconds before changing lanes."

The study contrasts sharply with the findings of another, which was carried out by the UK's Transport Research Laboratory. Entitled Collisions Involving Pedal Cyclists on Britain's Roads: Establishing the Causes, after looking at a wide range of data, the study established that motorists were to blame in around 50 per cent of accidents, with cyclists to blame 39 per cent of the time.

A legal specialist with no win, no fee injury claims specialist YouClaim comments, "Although these studies make for interesting reading and can be useful both in understanding road user behaviour and in shaping future road safety policy, it is essential that road accident compensation claims involving cyclists are looked at on a case-by-case basis."
