Accidents with garden tools may result in personal injury

Gardening is a hobby enjoyed by millions of Britons in their own homes and there is much satisfaction to be gained from seeing flowers, fruit and vegetables flourishing but there are many potential scenarios for personal injury accidents to affect both the householder and any visitors to a garden.

Less than a century ago, gardening required a large degree of manual labour but much of that has now been replaced by mechanisation with power tools having a larger space in the shed than traditional spades and forks.

Lawn mowers, strimmers and hedge trimmers are the most common powered equipment used in many domestic gardens, some of which are run on petrol while others are connected to mains electricity.

Of course, it is up to the gardener to understand the importance of taking precautions when handling these type of tools in order to avoid an accident and keeping them well-maintained is important for continued safe use. However, if another person is involved in servicing the equipment, responsibility for its care could be devolved onto them.

If a mower is taken to a reputable business for servicing, sharpening and general maintenance, the owner of that firm may well be liable should an accident result because of faulty workmanship or parts which have not be replaced correctly.

Mower blades or other components could fly off from a machine which has not been repaired correctly or, in the case of an electric-cabled mower, worn wiring that has not been replaced could lead to a short circuit or electrocution.

Similarly, cables on trimmers need regular checks to ensure safety for the user and any other bystanders.

Ponds with fountains have become a popular feature in many gardens but where the water jets are operated by electricity great care must be taken over the safety of the power supply otherwise there is the potential for a severe injury.

Electricity and water combined are also used in power washers which are used for cleaning cars, patio surfaces and other similar outdoor maintenance jobs and, again, great care has to be taken by the operator to ensure safety for themselves and others when these are being handled.

The owner or maintainer of a garden has a duty to make visitors, even other members of their family, aware of the potential hazards from tools which are either being used or are in view otherwise they run the risk of being sued for compensation should an accident resulting in personal injury occur which should have been avoided.
