Cold calling from personal injury solicitor firms is against the law

If you receive an unsolicited call from a personal injury solicitor or claims management company to your private home number or mobile line, asking if you wish to make an accident claim, the company is in violation of laws which regulate the accident claims industry and should be reported.

Personal injury solicitors at JMW LLP in Manchester highlighted a problem in August 2011 explaining that anyone who receives such a call should do their best to get a name and/or contact number for the firm and then contact the Claims Regulation Unit at the Ministry of Justice.

Richard Powell, head of the personal injury department at JMW said that cold-calling marketing strategies of this type are against the law. He added that their intrusive nature is damaging and encourages the types of "scurrilous" claims which have managed to give personal injury solicitors a "bad reputation".

Powell said, "This type of aggressive marketing just belittles those people who have suffered a genuine injury and harms their ability to get their claims heard by the courts quickly.

"It is aggressive and unwelcome marketing, and presents the wrong image of the legal profession."

Further, if you receive an unsolicited text to your private mobile phone line, this should be reported in the same way.

Reputable law firms will never call you unless you have approached them and offered your details. Even if you have, by coincidence, suffered personal injury as a result of a non-fault accident and are thinking of making a claim, do not be taken in by a company which approaches you out of the blue.

Always, seek out a law firm which you feel comfortable with and which does not pressure you into making a claim. If representatives of a firm attempt to make you proceed before you feel ready to go ahead, then it's a fair assessment that the service you will get will be unlikely to offer the type of representation you deserve and you may find your claim being handled by junior staff with little or no legal training.
